That was the question that Spider Robinson explored in Melancholy Elephants (1983). The story examines the interaction of copyright and longevity, and the possible effects of the extension of copyright to perpetuity.
The current bill (#SOPA) before Congress has reminded me of this story for some reason. On the surface, it is a Stop Online Piracy Act, but as you dig deeper you see where it could lead to so many issues. I really can't see the difference between what is going on today on the Internet and what went on in our garages as kids where we'd make mix tapes from each other's CDs and Tapes.
